What Should I Do If I Am a Victim of a Hit-and-Run Accident?

Victim of a Hit-and-Run Accident?

After an auto collision, all those involved are expected to exchange personal information with one another. This primarily ensures that all affected parties will have the means to hold the appropriate individual(s) responsible for the incident. Unfortunately, this is precisely the reason why some drivers avoid the provision of such information altogether. Often, this means that guilty drivers may flee the crash scene, creating what is known as a “hit-and-run” accident. If you have been the victim of such circumstances, the following guide shows how to proceed in filing your claim.

What to Do After a Hit-and-Run Accident

One primary factor to understand about these accidents is that, as the victim, you still have the right to seek compensation with the assistance from an experienced hit and run accident attorney for the damages inflicted upon you in the incident. This right is not invalidated simply because the guilty driver decided to violate the law by leaving the scene prematurely. Unfortunately, though, your experience in recovering the necessary funds and holding the negligent driver responsible will be notably more difficult.

However, to ease the process just a bit, you’ll need to follow the guidelines below:

  1. Stay at the crash scene. Prematurely leaving the scene of an accident is a crime punishable by law. Since the negligent driver has already left, it’s your sole duty to remain at the crash site and await the responding authorities’ arrival.
  2. Contact the police. Any information you have concerning the individual that left the scene should be given to the law enforcement officers. Details including the license plate number, the vehicle’s color, and related specifics will increase the chances that the offending driver will be tracked down.
  3. Gather witness’ contact information. Nearby drivers and pedestrians may have picked up details of the negligent driver’s vehicle that you may not have noticed. Collect their contact information, as they may need to provide witness testimony in the future.
  4. Document the details of the scene. Gather as much evidence as possible, reflecting every possible facet of the collision. Note the positioning of your vehicle, the environmental conditions, and any damages incurred. Remember to record videos and take photos to depict all damages accurately.
  5. Go to the hospital. After you have recorded all possible data concerning your car crash, visit a medical professional. Not only will this alert you to injuries, but your physician will supply you with crucial documentation that reflects your physical condition immediately after the crash and any incurred expenses.

You will need to contact your insurance company as well and seek compensation via your uninsured motorist policy. However, correspondence with insurers after collisions can prove challenging at times, so getting in touch with a lawyer beforehand is advised.

Hire a Lawyer

A hit-and-run car accident lawyer will guide you in the litigation process following your collision. They will investigate your case and recover footage, documentation, and further evidence to demonstrate your victimhood in the crash, even without identifying information for the negligent driver. Get in contact with an experienced legal defender today to recover compensation for your damages, despite the runaway driver.
